General Terms & Conditions

The NLdigital Terms and Conditions, filed with the Dutch court Midden-Nederland, location Utrecht, apply to all our offers and contracts. These terms and conditions are attached hereto. You hereby agree that these terms and conditions are sent to you in electronic form. At your request we will send you these terms and conditions again free of charge.

Applicable Law

The subject matter and this agreement are governed exclusively by Dutch law. Any disputes arising from or related to this agreement shall be subject to the exclusive jurisdiction of the competent Dutch court.

Program-Specific Terms (SaaS)

In addition to the general terms, the following provisions apply specifically to your use of MechitCalc:

Service Nature

This is a Software-as-a-Service (SaaS) platform providing engineering calculation tools. Access is granted remotely via the internet. No physical software delivery, installation, or download is provided.

Engineering Calculation Outputs

The software functions solely as a calculation aid for qualified engineering professionals. It does not constitute certified engineering advice, regulatory approval, or a substitute for independent verification, site-specific analysis, or compliance with applicable codes, standards, or safety regulations (e.g., PED, EN 13445, ASME BPVC, ISO 15649).

User Responsibility & Verification

You remain solely responsible for validating all input parameters, material properties, and boundary conditions; independently verifying calculation outputs against applicable design codes; applying appropriate safety factors; and ensuring final compliance with local regulations, permitting requirements, and occupational safety laws. Algorithmic assumptions, model simplifications, rounding, or input errors may affect results.

Acceptance Mechanism

By proceeding, you acknowledge that you have read, understood, and accepted both the general NLdigital Terms and Conditions and these program-specific terms.
